SPRINGFIELD - The state attorney general's office is suing a company it contends accepted orders for wood pellets for winter heating while knowing the orders would not be filled.
The lawsuit, filed in Hampden Superior Court, names New England Pellet LLC, owner-president Stephen Zaczynski of Suffield and owner-chief executive officer Jason Tynan of East Longmeadow as defendants. A similar lawsuit was filed last December in Connecticut by the Connecticut Attorney General's Office.
Filed Tuesday, the Massachusetts suit states that the defendants solicited, advertised and sold pre-paid wood pellet orders when they knew the orders could not be filled, then repeatedly promised consumers the pellets would be delivered.
